Please read this privacy policy (“Policy”) carefully before using our Platform VYTVORY.
You are reading this Privacy Policy ("Policy") because you are using our website VYTVORY (vytvory.ua or vytvory.com) and or our pages in social networks, all of which are part of the VYTVORY Platform ("Platform").
This Policy describes the personal data that is collected or processed when you interact with the Platform. It also explains how your personal data is used, shared and protected, what choices you have relating to your personal data and how you can contact us.
1. Who is responsible for processing your personal data?
The VYTVORY platform (referred to in this privacy policy as "VYTVORY", "our", "we" or "us"), which is represented by legal entities from the following list: Private Entrepreneur Dmytruk Liudmyla.
2. What personal data do we collect, when and from what sources?
We ask you to provide certain personal data in order to provide you with the products or services you order. For example, when you place an order for services, contact our customer services, send requests to receive communications, create an account, participate in our events or contests, or use our Platform.
This personal data includes your:
- contact details, including name, email, telephone number and delivery address;
- login and account details, including name, password and unique user ID;
- personal data, including gender, hometown and purchase history;
- payment or credit card information;
- images, photos and videos;
- you physical info, including height and body measurements, your size;
- your personal preferences, including categories and customization options, wish list, and marketing preferences.
We may collect additional personal data from you to enable certain features on our Platform. This personal data includes your:
- social network information, including credentials and any information from your public posts about the Platform or your communications with us.
When you interact with our Platform, certain data is automatically collected from your device or web browser, as described below in the "Cookies and Pixel Tags" section. This data includes:
- Cookies, IP addresses, referred headers, data identifying your web browser and version, web beacons, tags and interactions with our Platform.
3. Kids
We do not knowingly collect personal information online and we do not allow children under age of 18 to use the platform.
4. Managing the personal data we collect
By using our Platform, we also provide timely notice or consent to certain activities. We may obtain this consent through the Platform or through standard permissions available on your device.
In many cases, your web browser or mobile device platform will provide additional tools that allow you to control when your device collects or shares certain categories of personal data. For example, your mobile device or web browser may offer tools that allow you to manage the use of cookies. We encourage you to familiarize yourself with and use the tools available on your devices.
We do not currently respond to "do not track" signals sent by web browsers.
5. Why and how do we use your personal data?
We use your personal data in the following ways:
5.1 To provide the features of the Platform you request
When you use our Platform, we use your personal data to provide the requested product or service. For example, if you place an order on the Platform or participate in an event or promotion, we will use the contact information you provide to contact you about the order, event or promotion. If you contact our customer service team, we will use information about you, such as shipping or payment information, or the service or customized product you purchased, to help you resolve a problem or question.
In many cases, in order to use certain features on our Platform, you may need to provide us with additional data or additional consent to use certain data in a certain way. For example, to share content on social media, you may be required to provide social media account credentials to sign in.
5.2 To communicate information about our products, services, events and for other promotional purposes
If you are already a customer of the Platform (for example, if you have placed an order with us), we may use the contact information you have provided to send you marketing communications about similar products or services of the Platform, where permitted by applicable law (unless you have opted out). In other cases, we ask for your consent to send you marketing information.
We may use the information you provide us, as well as information from other sources, for example to customize your use of the Platform, to personalize communications and advertising about our products and services that may be of interest to you. For registered users, this may include data collected during your interaction with our Platform that is associated with your account across devices.
5.3 To operate, improve and maintain our business, products and services
We use the personal data you provide us to operate our business. For example, when you place an order, we use this information for accounting, auditing and other internal functions. We may use personal data about how you use our products and services to improve your experience and help us diagnose technical and service problems and administer our Platform.
5.4 To protect our or others' rights, property or safety
We may also use personal data about how you use our Platform to prevent, detect or investigate fraud, abuse, illegal use, violations of our Terms of Use and Terms of Service, and to comply with court orders, government requests or applicable law.
5.5 For general research and analysis
We use data about how our visitors use our Platform to understand customer behavior. For example, we may use information about how visitors of the Platform search for and find products and services, and how they choose customization options, to better understand the best ways to organize and present product and service offerings on the Platform.
5.6 Other purposes
We may also use your personal data in other ways and will provide specific notice at the time of collection and obtain your consent if necessary.
6. Sharing of your personal data
6.1 Sharing the Platform
The Platform may share each of the categories of personal data we collect with the following types of organizations for the business purposes described:
- Employees of the Platform for the purposes and under the conditions specified above.
- Service providers that process personal data (including the personal data specified in the section "What personal information do we collect and when") for commercial purposes on behalf of the Platform, such as credit card and payment processing, delivery, hosting, management and maintenance, data accounting , email distribution, research and analysis, advertising, analytics, managing brand and product promotions, and managing certain services and features.
- Other third parties to the extent necessary to: (i) comply with government requests, court orders or requirements of applicable law; (ii) prevent illegal use of our Platform or violation of our Platform Terms of Use and our Policies; (iii) defend against third-party claims; and (iv) assist in the prevention or investigation of fraud (such as counterfeiting).
- Any other third party to which you have given your consent.
We may also transfer the personal data we have about you in the event that we sell or transfer all or part of our business or assets (including in the event of a reorganization, spin-off, dissolution or liquidation).
We do not sell your personal data!
7. Protection and management of your Personal Data
- Encryption and security: We use a variety of technical, administrative and organizational security measures, including encryption and authentication measures in certain circumstances, to ensure the security of your personal data. Despite our best efforts, no website, mobile application, database or system is completely secure or "hacker-proof". You can help keep your data secure by taking reasonable steps to protect your personal information from unauthorized disclosure or misuse.
- Retention of your personal data: We retain your personal data for as long as necessary to fulfill the purposes described in this policy, unless otherwise required or permitted by law. For example, we retain your account profile information for as long as you maintain your account on the Platform, but we may retain your order history longer to comply with legal obligations.
- Managing your personal data. You may have the right to request: (i) access to your personal data (both the categories of data we collect that are set out in this policy and individual types); (ii) correcting your personal data if it is incomplete or inaccurate; or (ii) deletion or restriction of your personal data under certain circumstances as required by applicable law. We do not sell your personal data. We will not discriminate against you for exercising these rights. If you request that your account be deleted, you may create a new account on the Platform at any time.
If you have a request about your personal data that cannot be answered in your account settings, please contact us. We will verify your request through a message sent to the email address associated with your account (so you must have access to that email account) or by asking you to provide information that matches what we have for you in our systems. You or your authorized agent may submit a request to exercise your rights.
Before we can act on your authorized agent's request, we may require proof of your identity and confirmation from the authorized agent that it can act on your behalf.
- Managing Your Content: You may request the removal of User Generated Content posted on the Platform, but please note that removal may not cover all possible locations, such as backups or sharing by other users, that were initiated prior to removal.
- Managing Notifications: You may opt-out by following the opt-out or unsubscribe instructions in the message or by contacting us. Contact information is in the "contacts" section.
8. Cookies
The Platform collects information, which may include personal data, when you use our Platform. We may use a variety of methods, such as cookies and pixel tags, to collect this information, which may include your (i) IP address; (ii) a unique cookie identifier, cookie information, and information about whether your device has software to access certain features; (iii) unique device identifier and device type; (iv) browser domain, type and language, (v) operating system and system settings; (vi) country and time zone; (vii) previously visited websites; (viii) information about your interactions with our Platform, such as click behavior, purchases and preferences; and (ix) access times and link URLs.
Some advertising and technology partners may also collect personal data when you use our Platform. These partners have undertaken to act as service providers on behalf of the Platform and have undertaken to use your personal data only for the purposes of the Platform as described in this Policy.
We may use cookies and pixel tags to track the use of the Platform and to understand the preferences of our customers. This allows us to provide services to our customers and improve their online research. We also use cookies and pixel tags to obtain aggregated data about Platform traffic and Platform interaction, identify trends and obtain statistics so that we can improve our Platform. Our platform may use three categories of cookies:
- Functional: these cookies are necessary for the basic functionality of the Platform, so they are always enabled. This includes cookies that allow us to remember you when you explore our Platform during a single session or, if you prefer, from session to session. They help make shopping cart and checkout possible, and help with security and compliance.
- Performance: These cookies allow us to improve the functionality of our platform by tracking usage. In some cases, these cookies improve the speed with which we can process your request and allow us to remember the platform settings you have selected. Opting out of these cookies may result in poorly tailored recommendations and slow down the Platform.
- Social media and advertising: social media cookies enable us to connect you to your social networks and share content on our platform through social networks. Advertising cookies collect information to help better tailor advertising to your interests. In some cases, these cookies involve the processing of your personal data. Opting out of these cookies may result in you seeing advertisements that are not as relevant to you, or you may not be able to effectively connect to Facebook, Twitter or other social networks and/or may not allow you to share content on social networks.
Your browser can help you manage cookies. You can choose to have your computer alert you each time a cookie is sent, or you can disable all cookies. You do this through your browser settings on each browser and device you use. Each browser is slightly different, so check your browser's help menu to find out how to change cookies correctly. If you disable cookies, you may not be able to access many of the features that make our Platform more efficient, and some of our services may not function properly. Similarly, you can adjust your ad settings on your mobile device at the device level.
9. Use of the Platform with third-party products and services
Our Platform may provide links to other (third party) websites and applications for your convenience or information. Linked sites and applications have their own notices or privacy policies, which we strongly encourage you to review. Because any linked websites or applications are not owned or controlled by us, we are not responsible for their content, any use of the websites or applications, or the privacy practices of the websites or applications.
10. Changes to our Privacy Policy
Current legislation and our practices change over time. If we decide to update our Privacy Policy, we will post the changes on our Platform. If we materially change the way we process your personal data, we will give you advance notice or, if required by law, ask for your consent before making such changes. We strongly encourage you to review our Privacy Policy and stay informed of our practices.

If you contact us with a privacy complaint, it will be reviewed with the goal of resolving the issue in a timely and efficient manner.
12. Final Provisions
This Policy is compiled in two languages in which identical terms are stipulated. In the event of a difference between the texts, the Ukrainian language version shall prevail.
